Terms of Service

The short version (the long version below is what binds):

  • Pitch never owns the music. We do not, and will not, acquire any ownership of a track uploaded here. We never distribute, sell, publish, or play it to anyone.
  • By uploading a track you permit us to analyse the audio and keep the resulting measurements (numbers describing the sound - never the sound itself). The audio file is deleted within 24 hours.
  • Our reports are expert-style opinions built from measurements - not guarantees. Artist names in reports are market positioning references, not claims of affiliation.
  • Only upload a track you own or control. The uploader carries that responsibility in full; we screen for known releases.
  • Digital reports are generated on payment and are non-refundable once generation starts. If a failure on our side stops delivery, contact us within 7 days and we will re-generate the report (or, if you paid with credits, put those credits back).

1. About these terms

These Terms of Service (“Terms”) govern your access to and use of the Pitch Your Music website and all associated products and services (“the Service”) operated by Pitch Your Music (“Pitch”, “we”, “us”).

By uploading a file, creating an account, or making a purchase, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent and warrant that you meet this requirement.

3. Uploaded music: our position, and the licence you grant us

3.1 Pitch claims no ownership of uploaded music

Pitch does not own, and will not acquire, any right, title, or interest in any track uploaded to the Service. Nothing in these Terms transfers ownership of any track to Pitch. We acquire no right to distribute, publish, sell, sublicense, stream, or publicly perform any uploaded audio, and we never will under these Terms.

Pitch also takes no position on, and is not a party to, any question of ownership, authorship, copyright, royalty, licensing, or other rights in an uploaded track. We are not an authority on who holds those rights and we do not adjudicate them. Any such question is a matter between the uploader and any third party with a claim, and is governed by section 3.3 below.

3.2 The Analysis & Index licence

By uploading audio, you grant Pitch a limited, non-exclusive, royalty-free, worldwide licence to:

  • Analyse the audio with automated systems to produce your reports; and
  • Retain and use the derived measurements - numerical descriptors such as tempo, key, loudness, mood profiles, and mathematical audio fingerprints - to deliver, maintain, and improve the Service, including powering anonymous, aggregate features such as sonic-similarity matching.

To be unambiguous: derived measurements are numbers, not music. The audio cannot be reconstructed, heard, or recreated from them. The uploaded audio file itself is permanently deleted from our systems within 24 hours of upload. Derived measurements are never published in a form that identifies you or an unreleased track you uploaded without your separate, explicit consent.

3.3 The uploader is responsible for what is uploaded

By uploading a track, you represent and warrant that:

  • You own, or hold all rights necessary to submit, the audio you upload, and you have the authority to grant the licence in section 3.2;
  • Uploading it does not infringe any third party's rights (including co-writers, producers, samples, and labels);
  • You will not upload commercially released tracks you do not control, cover recordings, or unlicensed samples.

We operate automated fingerprint screening; uploads matching known commercial releases may be blocked. Screening is a precaution, not a verification of rights, and a track that passes screening carries no implication that Pitch has assessed or accepted any claim to it.

You agree to indemnify and hold Pitch harmless from any third-party claim arising from your breach of this section. If a track is uploaded by someone with no right to upload it, responsibility for that rests entirely with the uploader, on every account, and not with Pitch.

4. What our reports are - and are not

4.1 Engine-generated opinions grounded in measurement

Reports are produced by automated analysis and the Pitch engine. They are professional-style opinions and recommendations derived from measurements of the uploaded audio, information you provide, and public market data. They are not statements of fact about future outcomes.

4.2 No guarantees, ever

Every projection in a report is an estimate produced by the Pitch engine from measurements, and is subject to real-world market forces outside our control. Estimates are for planning only. Read all recommendations carefully before committing money to them.

Any numbers in a report - projected costs, audience ranges, engagement bands - are estimates for planning, expressly not promises. Pitch does not guarantee streams, views, playlist placements, curator responses, chart positions, revenue, or any other outcome, and nothing in a report should be read as a forecast of one. Marketing results depend on factors outside anyone's control. You are solely responsible for decisions you take - including money you spend - based on a report.

4.3 Artist names in reports (“positioning comparables”)

Reports may reference real artists' names to describe market positioning - for example, indicating that the analysed track's measured profile suits an audience that also listens to a named artist. Such references are editorial, nominative references only. They do not assert or imply: any affiliation, sponsorship, or endorsement by the named artist; that the named artist has heard the track; or that a direct audio comparison between recordings was performed. All third-party names and trademarks remain the property of their respective owners.

4.4 Third-party public data

Reports and features may include publicly available statistics (for example, subscriber or view counts) retrieved from platforms such as Spotify and YouTube via their official interfaces. Pitch is not affiliated with, endorsed by, or sponsored by these platforms; their data is presented as retrieved, and we make no warranty as to its accuracy.

5. Payments, credits, and refunds

5.1 Purchases

The free decode is available subject to fair-use limits. Paid packages (Blueprint, Arsenal, Rescue) are one-time purchases at the USD price shown at checkout; your payment provider may convert to your local currency at its live rate. Prices may change at any time; the price you see at checkout is the price you pay.

5.2 Credits

Credits are a prepaid balance usable toward packages, upgrades, and add-ons at the rates shown in the dashboard. Credits never expire, are non-transferable, have no cash value, and are non-refundable once purchased, except where required by law. Promotional or referral credits may carry additional conditions stated at grant.

5.3 Non-refundable purchases, and the delivery remedy

Report generation begins automatically the moment payment is confirmed - typically within seconds - and consumes computational resources immediately. Purchases are therefore non-refundable once generation has begun. Pitch does not operate a general refund, cancellation, or change-of-mind facility, and a delivered report cannot be returned.

If a technical failure on our side prevents delivery of a report you have paid for, you may submit a request to support@pitchmusic.io within 7 days of purchase, describing the order and what you received. On a valid request we will put you back in position by re-generating and delivering the report. Where the package was paid for with credits, we may instead restore those credits to the account that spent them, at our election. These remedies are provided in place of a refund.

Nothing in this section limits any remedy that cannot be excluded under applicable consumer law, including the Consumer Protection Act, 2019.

5.4 Payment processing

Payments are processed by Razorpay or Stripe. We never receive or store your card number, CVV, UPI PIN, or banking credentials. By purchasing, you also agree to the applicable processor's terms.

6. Permitted and prohibited use

You may use the Service for lawful music-marketing purposes, personal or commercial.

You may not:

  • Scrape, bulk-extract, or systematically harvest outputs, or use them to train competing systems;
  • Reverse-engineer any part of the Service;
  • Circumvent rate limits, authentication, payment flows, or the referral program's rules (including fake accounts);
  • Resell reports as standalone products without written permission;
  • Upload malicious files or content that violates any applicable law.

7. Referral program

Referral rewards are granted per the rules displayed in the dashboard. Rewards require genuine, distinct human signups and purchases; we may withhold or reverse rewards obtained through self-referral, fake accounts, or other manipulation, and may suspend accounts engaged in referral fraud. The program may be modified or ended at any time; rewards already credited are not withdrawn retroactively.

8. Account termination

8.1 By you

You may delete your account at any time from Dashboard → Account. Deletion is permanent. Personal data is handled per our Privacy Policy. Unused credits are forfeited on deletion except where a refund is required by law.

8.2 By us

We may suspend or terminate accounts that breach these Terms, engage in fraud, or pose risk to the Service or other users. Where practical and legally required, we will give reasonable notice.

9. Intellectual property

The Pitch platform - software, design, brand, and the Signal Check mark - is owned by or licensed to Pitch Your Music. Reports delivered to you are licensed to you for use in connection with your music career, including commercial use; you may not resell them as standalone products.

10. Disclaimers and limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.

To the maximum extent permitted by law: (a) Pitch's total aggregate liability for all claims arising from or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim; and (b) Pitch is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages - including lost revenue, lost profits, lost data, lost opportunity, or reputational harm - even if advised of the possibility.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud.

11. Indemnity

You agree to indemnify and hold harmless Pitch and its operators from claims, damages, and reasonable costs (including legal fees) arising from: your breach of these Terms; your uploads infringing third-party rights; or your unlawful use of the Service.

12. Governing law and disputes

These Terms are governed by the laws of India. Subject to any non-waivable consumer rights in your place of residence, courts at Mumbai, Maharashtra shall have exclusive jurisdiction. Before formal proceedings, please contact support@pitchmusic.io - most issues resolve quickly.

13. Changes to these terms

We may update these Terms. For material changes, registered users receive email notice at least 14 days before effect. Continued use after the effective date constitutes acceptance.
